====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-09-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 342, 384 of the Indian Penal Code.
3. As per complaint case, on 19.01.2021, when complainant was on his way to civil court, all the accused persons, including this petitioner, forcibly took him in a vehicle and demanded Rs. 16,00,000/- as extortion and took his signature on plain paper. It is further alleged that on 13.2.2021, when complainant was going to deposit cheque in Sri Finance, the accused persons snatched away the same. Again on 05.12.2021, the accused persons entered the house of
Patna High Court CR. MISC. No.57843 of 2025(3) dt.15-09-2025 2/3 complainant and assaulted him and his family members and took away Rs. 50,000/-.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, complainant took loan of Rs. 7,50,000/- from the petitioner for purchasing vehicle and assured that he would return entire money on time but the same was not returned to the petitioner. Present false and concocted case has been lodged only with a view to grab the money of petitioner and harass him. F.I.R. has been lodged after inordinate delay of about one year which itself raises doubt over veracity of the prosecution case. It is further submitted that similarly situated co-accused, namely, Anish Kumar, having similar allegation, has already been granted anticipatory bail by this Hon'ble Court vide order dated 02.09.2025 passed in Cr. Misc. No. 57209 of 2025.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the backdrop of the case, nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond
