Petitioner apprehends his arrest in connection with Maheshkhunt P.S.Case No. 171 of 2017 registered for the offences punishable under Sections 420,409 and 468 of the Indian Penal Code.

Allegation against the petitioner is of committing financial irregularities in the construction of 'Sauchalay' and preparing false bill.

Submission of learned counsel for the petitioner is that he is a ward member and in no way concern with the payment of money and he has falsely been implicated in this case. Further submission is that similarly situated accused has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 06-04-2018 passed in Cr.Misc.No. 12258 of

Patna High Court Cr.Misc. No.10818 of 2018 (3) dt.24-04-2018 2/2 2018.

Heard learned APP also.

Having heard both sides and in view of the fact that similarly situated accused person has been granted privilege of anticipatory bail, let the petitioner surrender in the court below within a period of four weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Khagaria, in connection with Maheshkhunt P.S.Case No. 171 of 2017 on the condition that petitioner shall have to co-operate in investigation and appear before the police as and when required, otherwise his bail bond shall be cancelled.

With the above observation, this application is disposed of.
