The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

As per the prosecution case, co-accused Chitranjan Sharma and his five associates looted cash of the informant on the gun point.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Bitu Kumar. No incriminating material has been recovered from the conscious possession of the petitioner.

Test Identification Parade has not

Patna High Court CR. MISC. No.67843 of 2021(2) dt.03-03-2022 2/2 been carried out till date. Petitioner has claimed clean antecedent and he is in custody since 6.6.2021. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Chanpatia Police Station Case No. 291 of 2021.
