The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 504/34 of the Indian Penal Code and section 3(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that while the informant was travelling on a motorcycle with Jagat Singh, the accused persons assaulted Jagat Singh when informant made protest then he was being abused by calling caste name.

It is submitted by learned counsel for the petitioner that for the same incident Jagat Singh has also lodged Bhabhua P.S.

Patna High Court Cr.Misc. No.31062 of 2015 (2) dt.05-08-2015 2/2 Case No.145 of 2015 on 30.03.2015 levelling accusation under sections 341, 323, 379, 307 and 427/34 of the Indian Penal Code wherein the petitioners have been granted bail and for the same incident the present informant Akhay Paswan lodged the present case on 01.04.2015 adding the provisions of SC/ST Act to make the case serious.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhabhua in connection with SC/ST Bhabhua P.S. Case No.17 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
