JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-10-2016 The petitioner is languishing in custody since 08.07.2016 in a case registered for the offences punishable under Sections 16/20C of the Narcotic Drugs & Psychotropic Substances Act.

From the possession of the petitioner 124 sachets total 900 grams of ganja were recovered. It is submitted by learned counsel for the petitioner that recovery is of small quantity. It is further submitted that though the petitioner is accused in Special Case No. 75 of 2014 registered under Sections 20 and 22 of the Narcotic Drugs & Psychotropic Substances Act, but he is on bail in that case.

Mr. J.N. Thakur, learned A.P.P does not controvert the quantity of recovery.

Considering the small quantity of recovery, let

Patna High Court Cr.Misc. No.36113 of 2016 (4) dt.28-10-2016 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Patna in connection with Special Case No. 39 of 2016, arising out of Kotwali P.S. Case No. 318 of 2016. Learned Court below will be at liberty to cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
