In this case, the petitioners are apprehending their arrest in connection with Parbatta (Maraia) P.S. Case No. 217 of 2016 (G.R. No. 1939 of 2017) registered for offences under sections 341, 324, 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
It has been alleged that while the Informant after purchasing vegetable reached near the field of Rajendra Yadav, the petitioners and other co-accused namely Satyabrat Yadav suddenly appeared before him and Sayhabrat Yadav @ Halkhori Yadav took out pistol from his west and made firing but the same
Patna High Court Cr.Misc. No.30767 of 2017 (3) dt.20-07-2017 was missed, whereupon, he has tried to cause knife blow injury on his back and whereupon the Informant caught the knife and sustained cut injury in his hand. On arrival of his brother and wife, the accused persons fled away.
In fact there is no injury received by the Informant and if any injury is said to have received is not on a vital part of the body.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Pulkit Yadav and Mohit Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Khagaria in connection with Parbatta (Maraia) P.S. Case No. 217 of 2016 (G.R. No. 1939 of 2016), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
