Petitioner apprehends his arrest in connection with Dhoraiya P.S.Case No. 142 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is of committing murder of his wife.

Submission of learned counsel for the petitioner is that marriage was solemnized 13 years ago and, as a matter of fact she has committed suicide and petitioner has taken her to hospital and even informed her family members about her death. Further submission is that one witness has stated during course of investigation that she has committed suicide. Heard learned APP also.

No.14470 of 2018 (3) dt.24-04-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner surrender in the court below within a period of four weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Dhoraiya P.S.Case No. 142 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that petitioner has to co-operate in trial.
