2. The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 1127 of 2023 for the offence registered under Sections 461, 379, 411 of the I.P.C.
3. As per prosecution case, 24 pieces of battery were stolen from a mobile tower and the petitioner was driving the pick-up van on which the said stolen batteries were loaded.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The petitioner was not named in FIR. He further submits that except the confessional statement of co-accused Rampravesh Rai, there is no material against the petitioner and
Patna High Court CR. MISC. No.62875 of 2024(5) dt.29-11-2024 2/2 nothing was recovered from possession of the petitioner. Similarly situated co-accused has already been granted regular bail by this Court vide order dated 18.01.2024 passed in Cr. Misc. No. 83393 of 2023. Petitioner has six criminal antecedents in which he is on bail. Petitioner is in jail custody since 09.04.2024. Charge-sheet has already been submitted in this case and there is no chance of tampering with the evidence. Petitioner undertakes to cooperate in the trial of this case.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Ahiyapur P.S.
