The petitioner apprehends his arrest in connection with Nawkothi P.S. Case No.48 of 2016 registered under Sections 452, 386, 504 and 506/34 of the Indian Penal Code. The accusation is that five persons, named in the F.I.R., including the petitioner and 5-6 unknown armed with rifle, carbine and pistol came on Bolero vehicle and 3-4 motorcycles at the house of the informant and, thereafter, co-accused Ajay Singh while abusing the informant, started searching him but the informant concealed himself in the house. After that, they entered the house of the informant and the co-accused Ajay Singh pointed

Baby Kumari, the wife of the informant, is the elected member of Panchayat Samiti of Maheshwara Panchayat and is also contesting the election of Block Pramukh. The wife of the petitioner is also the elected member of the Panchayat Samiti of Pahsara Paschimi Panchayat and she is also contesting the election of Block Pramukh. The coaccused Ajay Singh wants to make the wife of the petitioner as Block Pramukh, due to which the occurrence took place. At that time, the co-accused Ajay Singh asked the informant for not contesting the election of Block Pramukh by his wife, which the informant refused.
Then, the co-accused Ajay Singh and Akla alias Ram Kumar Singh pointed the pistol at the informant and the co-accused Ajay Singh made demand of Rs.5,00,000/- as ransom from the informant and to save his life, the informant gave Rs.10,000/- to him immediately making request to give some time to pay the rest amount. The co-accused Akla alias Ram Kumar Singh snatched the gold chain worth Rs.30,000/- from the neck of the informant.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the wife of the petitioner and the wife of the informant are contesting the election of Block Pramukh and due to village rivalry, this case has been lodged by the informant making
Patna High Court Cr.Misc. No.36481 of 2016 (2) dt.02-09-2016 3/3 the allegation of demand of ransom. Further submission is that the petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Vinit Kumar, Judicial Magistrate, First Class, Begusarai, in connection with Nawkothi P.S. Case No.48 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
