JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-07-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends her arrest in connection with Kharagpur P.S. Case No. 22 of 2021, registered for the offences punishable under Sections 25 (1-a), 25(1-AA), 25(1-B)A, 26(i) (ii), 35 of the Arms Act.

As per allegation, police got a secret information that coaccused Pappu Sah after being released from jail was re-engaged in manufacturing and smuggling of arms and ammunition. The place of occurrence was raided and a number of arms fully manufactured, semi finished were recovered.

Three persons Shambhu Vishwakarma, Arvind Kumar

Patna High Court CR. MISC. No.68001 of 2021(2) dt.25-07-2022 2/2 Sharma and Jai Kumar Sharma were arrested at the spot and they disclosed the complicity of the present petitioner. Learned counsel for the petitioner has submitted that the petitioner is a widow lady. She has clean antecedent. Nothing was recovered from her possession. Her name was figured in the confessional statement of co-accused persons. Considering the above-mentioned facts and circumstances especially that the petitioner is a widow lady and she is a person of clean antecedent, let her, in the event of her arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM IV, Munger in connection with Kharagpur P.S. Case No. 22 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bond shall be accepted provisionally and after verification of the criminal antecedent of the petitioner it shall be confirmed by the court below itself.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
