JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,324,307,448,380,504 and 506 of the Indian Penal Code.

It is alleged that on the order of the petitioner no. 1 Santosh Jha, petitioner no. 2 Baua Kant Ray assaulted with farsa to the informant causing injury on the eyebrow. Other accused persons also assaulted the informant. It is further alleged that petitioner no. 6 Dilip Kumar Jha, petitioner no. 7 Ashutosh Jha and petitioner no. 4 Bhola Nath Rai took away the brief case containing cash and ornaments.

Patna High Court Cr.Misc. No.29341 of 2015 (2) dt.27-07-2015 2/2 It is submitted by the learned counsel for the petitioners that the petitioners are agnates of the informant. Injury has been found to be simple and the informant subsequently retracted from the initial version and has filed a petition to that effect before the learned court below (Annexure 3). Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Bakhtiyarpur P.S. Case No. 213 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
