JUSTICE SUDHIR SINGH ORAL ORDER 07-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Bagaha Mahila P.S. Case No. 14 of 2017 for the offences instituted under Sections 366(A) and 506/34 of the IPC. The prosecution story, in brief, is that on 22.03.2017 at about 2.30 P.M., the petitioners alongwith Sabir Ansari procreation his minor sister Tamanna Nessa aged about 15 years. It is further stated that he is not present at his house then the petitioners happened this occurrence. Ealier Sabir Ansari caught with his sister and a panchayatee was made and at that time accused persons gave an ultimatum that they have run away with
Patna High Court Cr.Misc. No.28022 of 2017 (2) dt.07-07-2017 2/2 the sister of the informant sister and the informant will do nothing. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. They have falsely been implicated in the present case. The victim girl has been recovered. Her statement under Section 164 Cr. P.C. was recorded. She had not supported the allegation made in the F.I.R.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Bagaha Mahila P.S. Case No. 14/2017 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bagaha, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
