The petitioners apprehend their arrest in connection with Nayagaon P.S Case No. 07 of 2017 registered for the offences punishable under Sections 341, 323, 379, 504, 376 of the Indian Penal Code and Section 27 of the Arms Act. Allegedly, the petitioners and co-accused at the point of Katta and showing fear of murder of her children, committed rape one after another and further snatched Mangalsutra, ear-ring and Payal.
Submission is of false implication and that occurrence is of 01.01.2017 whereas, complainant case was filed
Patna High Court Cr.Misc. No.26800 of 2017 (2) dt.13-07-2017 on 12.01.2017, no explanation has been given for delay in lodging the case. There is land dispute between the parties. There is no corroborative material against the petitioners and, as such, the petitioners deserve sympathetic consideration Learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of pre-arrest bail by submitting that the petitioners have committed serious and heinous crime.
In the facts and circumstances stated above, this Court is not inclined to grant the privilege of pre-arrest bail to the petitioners and accordingly, their prayer stands rejected in connection with Nayagaon P.S. Case No. 07 of 2017 pending in the Court of learned A.C.J.M. XIII, Saran at Chapra. (Jitendra Mohan Sharma, J) sushma/- U T
