Petitioner apprehends his arrest in Saraiya P.S. Case No.22 of 2004 instituted for the offence under Section(s) 304-B, 201 Indian Penal Code pending in the Court of the SubDivisional Judicial Magistrate, West, Muzaffarpur. It is alleged that this petitioner was married with daughter of the informant on 09.02.2003. She was tortured in her Sasural for demand of rupees fifty thousand, colour TV etc. The daughter of Informant always complained to Informant about the torture committed with her by the petitioner and other accused persons. It is alleged that on 30.07.2003, this petitioner visited the house of the Complainant and made request for Bidagari. The daughter of the informant returned to her matrimonial house on

Patna High Court Cr.Misc. No.25987 of 2018 (3) dt.17-05-2018 2/2 01.08.2003. Father of the deceased visited her Sasural on the occasion of Raksha Bandhan on 11.08.2003 and got information from the neighbour that his daughter has already been killed on 12.03.2003 by this petitioner and other accused persons. Counsel for the petitioner submits that the girl died due to Hepatitis B.

From the Complaint Petition, which was sent to P.S. under Section 156 (3) Cr.P.C, it appears that no information was given about the death of the girl to her family members and she died in her Sasural.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
