That this writ application is directed for issuance of an appropriate writ in the nature of certiorari/mandamus for quashing the impugned Memo No.620 dated 27.04.2018 whereby and whereunder District Magistrate, Katihar has declined to pay the salary of the suspension period of the petitioner and for a direction to pay the salary of the petitioner for the suspension period i.e. from 27.01.2012 to 04.12.2013 excluding the paid subsistence allowance."

At the outset, the learned counsel for the

Patna High Court CWJC No.20043 of 2021(2) dt.21-03-2024 2/2 petitioner submits that since the relief sought by the petitioner in the present case depends on the outcome of review petition filed by the petitioner bearing Civil Review No.93 of 2020, he be permitted to withdraw the present case with liberty to seek additional relief in the said review petition or in the alternative approach this Court, in case the aforesaid review petition is disposed off in favour of the petitioner. Liberty so sought is granted.

The writ petition stands disposed off.
