2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 307, 354 and 34 of the Indian Penal Code.
3. Prosecution case , in brief, is that on 17.05.2023 when the informant Saukat Ali was on his way to the coaching center, his relatives Asgar Ali (petitioner No. 1), co-accused Gulsan Ara, Mehjabin Praveen (petitioner No. 2 ) and co-
Patna High Court CR. MISC. No.61260 of 2023(3) dt.13-12-2023 2/3 accused Hazrin surrounded him and started abusing him due to land dispute. When the informant protested, they took out knife and stabbed him in his stomach. The informant fell down and all the four accused started beating him with kicks, fists and danda.
4. It is submitted on behalf of the petitioners that there is general and omnibus allegation against these petitioners. Though there is allegation of assault with knife but there is no injury report on the record. Moreover, there is land dispute between the parties due to which a quarrel took place between them. There is case and counter between the parties. Petitioners claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Court No. 7 the learned Judicial Magistrate 1st Class (East ), Muzzaffarpur in connection with Katra P.S. Case No. 132 of 2023 , subject to the conditions laid down under section 438(2)
