2. The petitioner seeks regular bail in connection with Majorganj P.S. Case No. 420 of 2024 registered for the offence under Sections 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 21(C) of the NDPS Act.

3. Earlier the petitioner was granted bail vide order dated 16.04.2025 in Cr. Misc. No. 17200 of 2025 with a direction to the Sessions Judge to verify the antecedent of the petitioner as the petitioner claimed clean antecedent. The petitioner had suppressed his criminal antecedents and therefore at the time of furnishing the bail bonds, the same was not accepted by the Court Below.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.58317 of 2025(2) dt.26-09-2025 2/2 petitioner is innocent and has not committed any offence. Petitioner is in custody since 11.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as the period of custody, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Sitamarhi in connection with Majorganj P.S. Case No. 420 of 2024, subject to condition that:- (i). The petitioner will mark his attendance at the Sitamarhi Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
