The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.06.2021, charge-sheet has been submitted in the case and has antecedent of four cases. It is submitted that all the four F.I.Rs in which the petitioner has been made an accused were registered against unknown. Learned counsel for the petitioner submits that allegation is of looting the informant of Rs. 2.5 lakhs by two unknown criminals, further the informant claimed that she can identify the accused if she sees them.

No.68332 of 2021(2) dt.20-04-2022 2/2 Learned counsel for the petitioner submits that the F.I.R. was against unknown, no incriminating article was recovered from his possession and the name of the petitioner came in the confessional statement of co-accused Rajan Yadav. It is further submitted that despite the informant claiming to identify the accused and the petitioner being in custody but still he has not been put on T.I.P.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.06.2021, charge-sheet has been submitted in the case, his name came in the confessional statement of the co-accused and was not put on T.I.P., let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Hajipur Town P.S. Case No. 159 of 2021.
