Patna High Court CWJC No.9120 of 2017 dt.01-09-2017 2/3 INC- 003/16/2017/228741, dated 25/28.04.2017, whereby, his application for correction of his son's name in the certificate, marks-sheet and other documents, issued by the CBSE, has been rejected.

2. The petitioner's son is said to have passed Secondary Examination, held by the CBSE, in the year 2016 with Roll No. 7157886, School No. 08240 and Centre No. 7082. His name in the certificate and marks-sheet, issued by the CBSE, has been entered as 'Rishabh'. It is the case of the petitioner that his son's name is 'Rishav Raj' and by mistake 'Raj' has been dropped, which is his surname.

Learned counsel, appearing on behalf of the CBSE, has though opposed the prayer made in the present application, but has not been able to distinguish this case from a case decided by this Court, in the matter of 'Kshitiz Vs. The Union of India & Ors.', on 13.04.2017 in CWJC No. 4477 of 2017. Similar controversy had arisen in that case, where the Court had directed the CBSE to allow addition of petitioner's surname.

4. The impugned letter, dated 25/28.04.2017, bearing No. CBSE/RO/PTN/M&M/INC-003/16/2017/228741, is, hereby, quashed.

5. The Secretary, CBSE, is directed to ensure

Patna High Court CWJC No.9120 of 2017 dt.01-09-2017 3/3 necessary correction by incorporating 'Rishav Raj', as the name of petitioner's son, in the marks-sheet/certificate and other documents, so issued and maintained by the CBSE.
