The petitioner seeks bail in a case registered under Section under Sections 409 & 420 of the Indian Penal Code. The prosecution case, in brief, is that government money, meant for Mid Day Meal, was misappropriated by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-07-2019. The petitioner has been falsely implicated in the present case. The petitioner has not submitted book of accounts in respect of Mid Day Meal. There is no outstanding dues with him. It is further submitted

Patna High Court CR. MISC. No.53745 of 2019(2) dt.28-08-2019 2/2 that the petitioner is ready to deposit an amount of Rs. 50,000/- in the court below which shall be subject to final outcome of the case.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs. 50,000/- in the court below which will be subject to final outcome of the case. On doing so, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S.
