The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 504 and 34 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that on the orders of this petitioner, his two sons fired causing gunshot injuries. Further the petitioner is said to have assaulted the other son of the informant namely Navaneet Kumar with an iron rod causing serious injuries on his head. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated by the informant who happens to be his full brother. The petitioner is in custody since 10.8.2021 and chargesheet has been submitted in the case. The application is opposed by learned A.P.P. for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner, the injury on Navaneet Kumar having been found to be simple in nature and the petitioner having remained in custody for 9 months, the Court directs the petitioner to be enlarged on bail in connection with Udakishunganj P.S. Case no. 134 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Madhepura.
