2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 127(2), 115(2), 117(2), 109(1), 303(2), 308(3), 74, 351(2), 352 and 3(5) of the BNS.
3. The case of the prosecution is that the petitioner and other persons including one Shyam Kumar Yadav assaulted the husband of the informant due to which his leg was fractured. Further allegation is that one Sonu Kumar snatched golden chain.
4. Learned counsel for the petitioner has submitted that from perusal of the FIR itself it is clear that the allegation

No.58469 of 2025(2) dt.27-08-2025 2/2 against this petitioner and Shiv Kumar Yadav is that they have assaulted the husband of the informant and they have caused the leg of the informant's husband fractured. From perusal of the order of the learned trial court it is clear that the informant has also received injury on his head which is not caused by the petitioner. The petitioner is in custody since 01.05.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Basnahi P.S. Case No. 253 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., First Class, Saharsa.
