The counsel for the petitioner submits that he was running a PDS shop under the valid license, but on account of his illness, he could not deposit the license fee, he repeatedly requested the respondent authority to accept it and renew his license but, utter surprise, the license of the petitioner has not been renewed, now the petitioner says that he is completely fit to run the PDS shop under the PDS Scheme.

Patna High Court CWJC No.14123 of 2016 (2) dt.17-04-2017 2/2 own merit about the renewal of the license of petitioner after taking renewal fee, as the counsel for the petitioner submits that the petitioner had regularly approached the authority concerned for acceptance of the renewal fee, but they purposely refused to accept it. He further submits that he is a marginal class of person, requires sympathetic consideration.

The Sub-Divisional Officer would decide the matter in accordance with law.

Accordingly, this petition is disposed of.
