JUSTICE RAKESH KUMAR ORAL ORDER 10-08-2017 Heard Sri Satya Prakash Parasar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Jamui P.S. Case No.34/2017 registered for the offence under Section 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that from a hotel of Rahul @ Ranjan Kumar, huge quantity of Indian Make Foreign liquor was recovered and the petitioner has been named as accused as if the petitioner along with one another accused had fled away from the said hotel. He submits that the petitioner is not the owner of the hotel, but only
Patna High Court Cr.Misc. No.29042 of 2017 (3) dt.10-08-2017 2/2 on the basis of confessional statement of co-accused, he has been made accused.
Considering the fact that the petitioner has been made accused only on the basis of confession of co-accused, there is no reason to deny the prayer for anticipatory bail. Let the petitioner, namely, Ranjeet Sao @ Ranjeet Sah , in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No.34/2017 , subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
