2. The accused/petitioner seeks bail in connection with Amnaur P.S. Case No. 82 of 2025 registered for the offences under Sections 310(4), 310(5), 310(6), 61(2) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.') and Section 25(1-B)(a), 25(1-AA), 26, 35 of the Arms Act.
3. The accused/petitioner is named in the First Information Report and is in custody since 25.03.2025.
4. Allegation against the petitioner is to involve in preparation of dacoity alogwith other co-accused persons.
5. It is submitted by learned counsel appearing on behalf of the petitioner that name of this petitioner transpired
Patna High Court CR. MISC. No.58954 of 2025(2) dt.13-10-2025 2/3 on the basis of confessional statement of co-accused namely, Arun Kumar Mahto, who has already been granted bail by this Court through Cr. Misc. No. 49241 of 2025 dated 10.09.2025.

It is submitted that no fire-arms appears to be recovered from conscious possession of this petitioner during course of investigation and merely on the basis of some photographs of live cartridge and pistol, which was found in the mobile of this petitioner, he was implicated with the present case.
7. It is submitted that almost no case is made out against the petitioner with the evidence collected during course of investigation, for which petitioner remains in custody since last six months.
8. While concluding argument, it is submitted that petitioner found involved in one more criminal case, where he is on bail and, moreover, investigation of this case is already completed and as such, there is no chance of tampering with the evidence.
9. Learned A.P.P. for the State has opposed the
Patna High Court CR. MISC. No.58954 of 2025(2) dt.13-10-2025 3/3 prayer for bail of the petitioner.

In view of aforesaid factual submission and by taking note of the fact as prima facie implication of this petitioner is based upon suspicion as some photographs of live cartridge and pistol was found in the mobile of the petitioner, coupled with the fact that petitioner remains in custody since 25.03.2025, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, Saran at Chapra/concerned court, in connection with Amnaur P.S. Case No. 82 of 2025, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
