1. Heard learned counsel for the petitioner and learned counsel for the respondent-University.

2. Learned counsel for the petitioner submits that in view of the pronouncement of the Hon'ble Supreme Court in its judgment in the case of P. Suseela & Ors. vs University Grants Commission & Ors. (2015) 8 SCC 129, nothing remains for the petitioner so far as the instant application is concerned and as such he may be permitted to withdraw this application. However, learned counsel for the petitioner further submits that in case any future vacancy arise, his case should be considered in view of the contents of the letter dated 9.3.2017 written by the Indian Council of Agricultural Research, Krishi Anusandhan Bhawan-II, Pusa, New Delhi to the Vice-

Patna High Court CWJC No.11631 of 2014(8) dt.14-12-2023 2/2 Chancellors of the Universities.

3. It may be stated with respect to the submissions made on behalf of the petitioner that since the same is with respect to vacancy which may arise in future nothing may be observed in the instant order. It will always be open to the petitioner to make an appropriate application, which the Court expects, would be considered by the respondents in accordance with law.

4. In view of the aforesaid submission of the learned counsel for the petitioner, this application stands disposed of as withdrawn.
