JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code.
It is alleged that petitioner executed a sale deed with regard to the land of Shri Baba Budhanath Mahadev Mandir Trust, Bhagalpur in favour of co-accused Rajesh Kumar Tiwari, Reena Tiwari, Kaushailiya Devi, Kumari Madhuri and Rimjhim Devi. It is submitted by learned counsel for the petitioner that the land in question is the ancestral land of the petitioner and some part of the land was donated by the ancestors of the petitioner whereas the co-accused have been granted anticipatory bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.16624 of 2015. Moreover, a statement has been made in
Patna High Court Cr.Misc. No.30726 of 2015 (2) dt.31-07-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No.46 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
