JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2024 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of an appropriate writ in the nature of Mandamus and/or any other appropriate writ, order or direction commanding upon the respondents, to remove the encroachment made on Public Aam Road in village-Panchgama bearing Survey Plot No.746, which is recorded in Revisional Survey Khatiyan as Rasta and further to

Patna High Court CWJC No.11685 of 2014(4) dt.01-05-2024 2/2 restrain the respondent No.6 for making any further encroachment by taking appropriate action/recourse in law against respondent No.6."

At the outset, the learned counsel for the respondent-State submits that the encroachment in question has already stood removed, however, the same is refuted by the learned counsel for the petitioner and he submits that the encroachment has resurfaced, hence liberty is sought for on behalf of the petitioner to approach the Circle Officer, Rosera, District-Samastipur, for redressal of his subsisting grievances. Liberty, so sought, is granted.

The writ petition stands disposed off.
