Mr.Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case initially registered under Sections 147, 148, 323, 380, 504, 307/34 of the Indian Penal Code but later on, cognizance has been taken under Sections364, 511 of the Indian Penal Code. The prosecution case in short is that with a view to grab the share of son of the first wife of one Sachidanand Pandit, the accused persons committed overt act with the complainant. It is also suspected by the complainant that the accused persons would have killed her maternal grandson namely, Peeyush Kumar.

Patna High Court CR. MISC. No.54716 of 2019(2) dt.30-08-2019 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 04-07-2019. The prosecution has been launched on the basis of a complaint. It is alleged that husband of the petitioner had tried to abduct his son. The petitioner happens to be step mother of the said Peeyush Kumar and for the said reason, she has been made accused in this case. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Roshan Kumar, learned Judicial Magistrate-Ist Class, Banka in connection with Complaint Case No. 906 of 2016.
