JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending her arrest in connection with Rudrapur P.S. Case No. 25 of 2017, G. R. No. 473/2017 for the offences instituted under Sections 420, 406, 409, 353, 504/34 of the IPC and 7 of the E.C. Act.

The prosecution story, in brief, according to the informant Block Supply Officer dated 04.04.2017 that a meeting was held on 11.03.2017 in which the Supply Officer as well as responsible persons was present. In the meeting, the matter regarding the criminal breach of trust changed, misuse of powers delegated to them was raised and after a consideration, this accused Srimati Manjula Devi was authorized to take care and proceed the P.D.S. shop, Karnpur into her supervision but this lady did not follow the guideline, did not inform the authorize

Patna High Court Cr.Misc. No.28507 of 2017 (2) dt.06-07-2017 2/2 regarding several illegal act being committed by the co-accused Raja Ram Kamat and also some serious illegalities were made against this accused then F.I.R. was lodged.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner was authorized to supervise the P.D.S. shop which was run by Raja Ram Kamat being the Chairman of PACCS and Mukhiya of Karnpur Panchayat. The petitioner has not made any distribution. The petitioner is a lady.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Rudrapur P.S. Case No. 25/2017 bearing G.R. No. 473/2017 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Jhanjharpur, Madhubani, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
