The petitioner is apprehending his arrest in connection with Begusarai Town P.S.Case no.67 of 2017 registered for offences punishable under Sections 65, 66 and 66(D) of the Information Technology Act, 2000.
Allegation against the petitioner, who is a meter reader is that he collected money from the consumers and not deposited the same. In this way misappropriated Rs.3.17 lac and odd and further allegation is that he also created some illegality in the software. Submission of the learned counsel for the petitioner is that no receipts of the consumer have been annexed and there is no complaint by the consumer and he has falsely been implicated in
Patna High Court Cr.Misc. No.25372 of 2018 (3) dt.29-06-2018 2/2 this case because he made complaint against the informant with respect to supply of illegal electricity in the water purifier plant. Heard learned A.P.P. and the learned counsel for the Bihar State Electricity Board. They have opposed the prayer for bail.. Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender along with a bank draft of Rs.1, 17,000/- in favour of Bihar State Electricity Board, within a period of six weeks from the date of receipt of the order and if he pays the aforesaid amount he shall be released on provisional bail for further two months with condition that he will deposit rest of the amount in four equal installments in the first week of every month, subject to result of the case, and failure to deposit any of the installment, his bail bond shall be cancelled, however, if the total amount is paid by the petitioner, his bail bonds shall be confirmed.
