ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with S.C./S.T. P.S. Case No.55 of 2014 for allegedly having committed the offences under Sections 147, 148, 341, 379, 384, 504 of the Indian Penal Code and Sections 3(i)(ii), 3(i)(x) of the S.C./S.T. Act.

Learned counsel for the petitioners submits that the present case has been lodged only because the opposite parties had been grazing their cattle in the field belonging to these petitioners. Learned counsel further submits that the allegation of having used caste name is made only to make the offence more graver and that the incident occurred at 12 O'clock in the night and as such, there

Considering the aforementioned submissions and the nature of allegations and also the fact that the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with S.C./S.T. P.S. Case No.55 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
