JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 This is an application for grant of anticipatory bail in connection with Balrampur P.S. Case No. 56 of 2019, disclosing offences under Sections 341, 323, 326, 307, 379, 504, 506, 34 of IPC.

Prosecution case is that the petitioners and other accused persons came and started damaging the house of the informant and also started assaulting him, causing injury. Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against any of the petitioners and there is case and counter case between the

Patna High Court CR. MISC. No.53976 of 2019(2) dt.28-08-2019 2/2 parties. Further submission is that petitioners no.1 to 3 are ladies.

Heard learned A.P.P. also, who has admitted the position that no specific allegation against any of the petitioners. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Katihar, in connection with Balrampur P.S. Case No. 56 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
