JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Mahisi P.S. Case No. 37 of 2015 registered under Sections-325, 354B, 379 & other minor sections of the Indian Penal Code.

Petitioner No. 1 happens to be full brother of the informant and so far as petitioner Nos. 2 & 3 are concerned; they are sons of petitioner No. 1. There is case and counter case between the parties and persons from both sides, sustained injury.

It appears that the occurrence took place on

Patna High Court Cr.Misc. No.29003 of 2015 (2) dt.27-07-2015 2/2 account of land dispute but unfortunately, in the said occurrence, the informant sustained one grievous injury on his hand, as a result of which, Section-325 of the Indian Penal Code was also added in the first information report. However, it is not specific as to who has caused the abovesaid grievous injury. Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mahisi P.S. Case No. 37 of 2015 to the satisfaction of Sri S. K. Jha, learned Judicial Magistrate, Saharsa subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
