Petitioner apprehends his arrest in connection with Kumarkhand (Belari O.P.) P.S. Case No. 05 of 2014 registered for the offences punishable under Section 420 of the Indian Penal Code and Section 7 of E.C. Act.
Allegation against the petitioner is of selling of fertilizer without having proper register.
Submission of learned counsel for the petitioner is that earlier bond was executed, as such he has not been arrested. Further submission is that earlier petitioner has moved this Court for grant of anticipatory bail which was disposed of as withdrawn vide order dated 11.9.2014 passed in Cr.Misc.No. 22990 of 2014. Heard learned APP also.
Patna High Court Cr.Misc. No.18550 of 2018 (3) dt.25-04-2018 2/2 Having heard both sides and in the facts and circumstances, it appears that the case is quite old and earlier order for withdrawal was passed in the year 2014, as such, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner should surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
With the above observation, this application is disposed of.
