The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Total 20 liters of country-made Chulai liquor has been recovered from the possession of co-accused Hare Ram Sah and from dickey of one Glamour motorcycle.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said motorcycle and has got no concern with co-accused Hare Ram Sah. Petitioner claims clean antecedent.

Considering the nature of allegation and clean

Patna High Court CR. MISC. No.56826 of 2022(2) dt.02-12-2022 2/2 antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Court, Saran at Chapra in connection with Manjhi P.S. Case No. 423 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
