The petitioner and the private respondent no. 5 are the daughter and son of late employee Baijnath Prajapati, who died in harness on 08.02.2014 while working on the post of Daftari in the Civil Court, Aurangabad. There was a compromise between the petitioner and respondent no. 5 that the petitioner would not be claiming any share in the ancestral property, movable or immovable, but would be entitled to half share of the death cum retiral benefits of their father late Baijnath Prajapati and for this

Patna High Court CWJC No.13571 of 2016 dt.02-01-2019 2/2 purpose a compromise was signed by both the parties on 04.07.2014, which is Annexure-2.

3. Considering the nature of prayer, this writ application is disposed of with a direction to the petitioner and respondent no. 5 to approach the respondent no. 2, the District Judge, Civil Court, Aurangabad with the said compromise arrived between the parties and the same would be processed by the respondent no. 2 within a period of three months from the date of filing of such compromise by the petitioner and respondent no. 5.
