JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-304B, 201/34 of the Indian Penal Code. Petitioner happens to be mother-in-law of the deceased.

It appears from perusal of the first information report that the deceased died within a month of her marriage. Moreover, the first information report reflects that the information, regarding the critical condition of the deceased, was given to the informant by husband of the deceased and having got the aforesaid information, he reached at the matrimonial home of the deceased on 18-05-2012 but he gave written report to the officer-in-charge

Patna High Court Cr.Misc. No.37735 of 2016 (2) dt.16-09-2016 2/2 on 25-05-2012 and, no explanation regarding the aforesaid delay has been given by him. Moreover, having more or less similar allegation, one co-accused has already been granted privilege of bail.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Imamganj P.S. Case No. 43 of 2012 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya.
