The petitioner apprehends arrest in connection with Parbatta (Bharat Khand O.P.) P.S. Case No. 5 of 2017 registered under Sections 399, 402 of the Indian Penal Code and sections 25(1-B)A, 26 and 35 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity on account of land dispute. The informant has been managed by the cousin uncle of the petitioner. F.I.R. does not reflect that seizure list was handed over to any person. Petitioner was neither arrested on the spot nor anything has been recovered from his possession.
Patna High Court Cr.Misc. No.14227 of 2017 (5) dt.31-07-2017 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Khagaria in connection with Parbatta (Bharat Khand) P.S. Case No. 5 of 2017 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
