The petitioner is apprehending his arrest in connection with Makhdumpur (Tehta) P.S. Case No.139 of 2015 for allegedly having committed the offence under Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the alleged recovery was not made in the presence of the petitioner and, in fact, seizure list does not indicate his signature. Learned counsel further submits that it is a first offence and as such, he may be extended the privilege of anticipatory bail. Considering the aforementioned facts and circumstances and also that the petitioner has no criminal

No.33032 of 2015 (2) dt.21-08-2015 2/2 antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Makhdumpur (Tehta) P.S. Case No.139 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
