JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Chakai P.S. Case No. 33 of 2015 registered for the offence punishable under sections 395/397 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in this case on confessional statement of coaccused, who named this petitioner due to local politics. During investigation, nothing has come against this petitioner to suggest his complicity in the alleged crime. Similarly situated coaccused has been granted bail by this Court vide order dated 06.02.2017 passed in Cr. Misc. No. 3530 of 2017. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the
Patna High Court Cr.Misc. No.28694 of 2017(3) dt.20-09-2017 2/2 submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Jamui in connection with Chakai P.S. Case No. 33 of 2015 subject to the conditions laid down under section 438(2) Cr.P.C.
