JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Petitioner apprehends his arrest in connection with Jankinagar P.S.Case No. 61 of 2017 registered for the offences punishable under Section 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping of minor daughter of the informant.
Submission of learned counsel for the petitioner is that the girl was major, which will appear from the Annexure-2, the certificate of In-charge Headmaster and she has solemnized marriage with the petitioner, which will appear from Annexure-4. Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner stating that in her statement under Section 164 Cr.P.C. the girl has stated that she was administered intoxicated substance and thereafter taken away and
Patna High Court Cr.Misc. No.25580 of 2018 (3) dt.26-06-2018 2/2 committed rape upon her.
Having heard both sides and considering the 164 Cr.P.C. statement of the victim girl, I am not inclined to grant privilege of anticipatory bail to the petitioner.
Let petitioner surrender and make prayer for regular bail, which shall be considered on its own merit.
