Petitioner seeks bail in a case registered under sections 304B, 201/34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased. Informant claims in his written report that marriage of the deceased with the petitioner had taken place in the year 2008 and according to the prosecution case itself, deceased died in the year 2014. The informant has also admitted in his written report that after marriage, deceased gave birth to four children out of the aforesaid wedlock. Moreover, there is not even a whispering regarding illegal dowry demand as well as torturing against the petitioner. Submission on behalf of the petitioner is that deceased died of her natural death but the informant lodged this case at the behest of enemies of the petitioner and moreover, when the informant learnt
Patna High Court Cr.Misc. No.36775 of 2016 (2) dt.31-08-2016 about real fact, he filed compromise petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge I, Saharsa in Sessions Trial no. 127/2016 arising out of Mahishi P.S. Case no. 86/2014.
