JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-08-2025 At the outset, learned counsel for the petitioners submits that during pendency of this bail petition, petitioner no. 2 namely Mithilesh Kumar has been arrested and as such, this petition has become infructuous so far as petitioner no. 2 is concerned.

2. The anticipatory bail petition stands dismissed, so far as petitioner no. 2 is concerned.

3. Rest petitioners (i.e. petitioner nos. 1 and 3) apprehend their arrest in a case registered for the offence under Sections 3126(2), 115(2), 118(1), 109, 303(2), 352, 351(2)(3), 3(5) of the B.N.S., 2023.

4. As per F.I.R., on 16.04.2025 at about 8:30 AM, these two petitioners and co-accused Mithilesh Kumar abused

Patna High Court CR. MISC. No.56228 of 2025(2) dt.25-08-2025 2/2 and assaulted informant and his son and grand-son.

5. Learned counsel for the petitioners submits that due to dispute over pathway, a simple Maarpeet took place in which both sides sustained injury. Case and counter case. Injuries, sustained by the injured, are simple in nature. Petitioner claims clean antecedent.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

7. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner no. 1 and 3 namely Siparsi Ray @ Siparasi Rai and Munna Devi be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Chapra in connection with Awtar Nagar P.S. Case No. 101 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S., 2023.
