The petitioner herein is the sister-in-law of the victim and has moved this application for anticipatory bail apprehending her arrest in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 81 of 2013 registered under Sections 498A, 323, 304B, 506 and 201 of the I.P.C.

The brother of the victim lodged this case alleging that his sister was done to death by the husband and in-laws in the matrimonial home on account of non-fulfilment of demand of dowry.

Counsel for the petitioner submits that from the order impugned, it would appear that the petitioner was present in the

Patna High Court Cr.Misc. No.30357 of 2014 (2) dt.14-01-2015 hospital when the victim was being treated of her burn injuries. On conclusion of investigation, the petitioner was not sent up for trial by the investigating agency. One of the co-accuseds namely father-in-law has since been released on anticipatory bail by this Court vide order dated 24.09.2014 passed in Cr. Misc. No. 26409 of 2014.

Considering the facts and circumstances of the case, in the event of her arrest or surrender within four weeks in the Court below, petitioner abovenamed shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., West, Muzaffarpur in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 81 of 2013 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailers shall be the own/close family members of the petitioner.
