Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case registered for the offences punishable under Sections 08, 20, 21, 22 and 23 of the N.D.P.S. Act, 1985.
The learned counsel for the petitioner submits that earlier by order dated 09.02.2022 in Cr. Misc. No.43835 of 2021, the bail application of the petitioner was rejected with a liberty to the petitioner to renew his prayer for bail after framing of charge. The learned counsel for the petitioner submits that inadvertently when the matter was taken up on 09.02.2022, by that
Patna High Court CR. MISC. No.59174 of 2022(2) dt.09-11-2022 2/2 time the charges were already framed, but in absence of instruction, the said submission could not be made. It is next submitted that the charges stands framed against the petitioner by order dated 08.02.2022 (Annexure-3 to the anticipatory bail application). Learned A.P.P. opposes the bail application.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bidupur P. S. Case No.585 of 2020, subject to condition that one of the bailors shall be the mother of the petitioner namely, Shama Pravin.
However, in the event, if the learned trial Court comes to a conclusion that if petitioner after his release on bail is trying to delay the trial in any manner, the learned trial Court shall forthwith cancel his bail bonds after recording reasons.
The application stands disposed of.
