ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioners, the learned counsel for the informant and the learned counsel for the State. The petitioners are apprehending their arrest in connection with Kusheshwar Asthan P.S. Case No.99 of 2015 for allegedly having committed the offences under Sections 341, 323, 386, 387, 379 and 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that it is, in fact, the informant who had created disturbance over possession of the land and having failed in a proceeding under Section 144
Patna High Court Cr.Misc. No.31146 of 2015 (2) dt.12-08-2015 2/2 Cr.P.C., the informant has resorted to filing the present case making false and frivolous allegation against the petitioners. Considering the aforementioned submissions and also the fact that the petitioners have no criminal antecedents, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Biroul, Darbhanga, in connection with Kusheshwar Asthan P.S. Case No.99 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
