The petitioner seeks bail in connection with Special Case No.24 of 2016, arising out of Jogbani P.S. Case No.81 of 2016, registered under Sections 20 and 22 of the N.D.P.S. Act. The accusation is that in course of checking of the vehicles, one bus bearing Registration No.BR-7P-2034 was searched and, in course of checking of the bus, one bag, containing intoxicated medicines, viz. 990 Diazelab (2 ml) INJ, 1000 Avil (2 ml.) INJ, 1000 Lypigesic (2 ml.) INJ, 300 strips of Nitrosum tablets (each strip of 10 tablets), 14 bottles of 100 ml. Corex syrup, recovered from the dickey of the bus. Patna High Court Cr.Misc. No.38344 of 2016 (5) dt.06-03-2017 2/2 submits that, in fact, the petitioner has falsely been implicated in this case on mere suspicion. The petitioner having no criminal antecedent is in custody since 02.07.2016. Moreover, the chargesheet has already been submitted against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Araria, in connection with Special Case No.24 of 2016, arising out of Jogbani P.S. Case No.81 of 2016.
