2. The petitioner seeks bail in connection with Ghoghardiha P.S. Case No. 18 of 2023 registered for the offence punishable under Sections 25(1-b) a/26/27/35 of the Arms Act.

3. This is the second attempt by the petitioner for his bail. Earlier, this Court vide order dated 16.04.2024 in Cr. Misc. No. 9608 of 2024 had dismissed the regular bail of the petitioner on merit.

4. As per the prosecution case, one country made pistol has been recovered from the petitioner.

5. Learned counsel for the petitioner submits that the petitioner is in jail since 1.3.2023 and the case is pending at the stage of appearance.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the period of custody of the petitioner

Patna High Court CR. MISC. No.67687 of 2024(4) dt.19-03-2025 2/2 and also considering the delay in the trial of the petitioner, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jhanjharpur, Madhubani in connection with Ghoghardiha P.S. Case No. 18 of 2023, subject to the following conditions: (i) One of the bailors shall be a close relative of the petitioner.

(ii) The petitioner, after being released on bail is directed to mark his attendance at Ghoghardiha Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

(iii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court.
