JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 25 bottles of Indian made foreign liquor are said to have been recovered from generator room of the petitioner for which petitioner is in jail custody since 26.07.2016. Submission on behalf of the petitioner is that the generator room of the petitioner is situated in outer side of the shop and moreover, mere possession of Indian made foreign liquor does not constitute any offence.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rosera in connection with Rosera
